Would the Secret Service guard Obama even if they have doubts about him ?  Of course they would.  That's their job, to protect and not to pass judgement on the principals.  

A person isn't required to be "Native-Born" to be a Senator.  It wouldn't have come up.   It would have been in folk's interest in the government to ignore any doubts i.e. State Department, FBI.

this is not rocket science or a conpericy.  It is simple facts of procedure.  The Hawaiian Government says he was born in Hawaii.  Berg cannot sue on behalf of the people or Government of Hawaii. 

If Berg has a problem with that, he should go to Hawaii and file a suit in Hawaiian court against the Government of Hawaii who duly, with proper legal authority, says Obama was born there. 

It is really that simple.  Why Berg does not do that?  Because the Hawaii courts would dismiss the case much like the Federal Court did. 

It is a groundless frivalis lawsuit that is a huge was of time and tax payer money. 

I don't think he's trying to sue on behalf of the people of Hawaii.  I think he's trying to sue on behalf of those who supported Hillary Clinton, based on the idea that if Obama were not a citizen, then his nomination would be invalid, and she would be the "winner" of the primaries - therefore the de facto nominee.

He's trying to say that those of us who supported Hillary were "robbed" of the chance to vote for our candidate in November due to Obama "fraudulently" claiming to be eligible to run for POTUS.

But the whole thing is ridiculous.  Obama IS a citizen, and that's been certified by the state of Hawaii. Furthermore, most of us who voted for Hillary in the primaries are now voting for Obama - by choice.  Hillary herself supports Obama, and is campaigning for him.   She's even said she probably won't run again in the future.

So, the only real problem is that people like Berg and those PUMA people haven't gotten over having their chosen candidte lose, and they're willing to sacrifice the welfare of the whole damn country to try and get their way.   I call that idiotic and childish.

Ive also read immigration law that says to lose citizenship once born in the US, one must renounce it and the renounciation must be recorded by a consulate.  Even a child born out of the US to an america citizen is considered a citizen, unless they fail to return to the the US at least once in 15 years.  That kinda blows a big hole in Berg's theories of non-citizenship.

Brian dude, there is no mass conspiracy by the Federal Judge or the Obama campaign or Obama supporters.  Staying on topic, if you actually read the opinion, the simple matter of what he said is that Berg has no standing based on what he presented.  It is plain and simple.  If Berg really wants to pursue the matter then he must put his butt on a plane, fly to Hawaii and sue the government of Hawaii in their courts first.  Regardless, the state of Hawaii says officially, Obama was born in Hawaii.  If the GOP contest that they must present their case to the Hawaiian Courts to establish whatever facts that they have to prove any kind of conspiracy to forge his Birth Certificate.  Otherwise, it is legitimate and he is a natural born citizen of a United State of America.

So, if the GOP wants to win, isn't it logical to think that if there were ANY truth to that claim, they would have already pursued it to the fullest possible extent?   What would be the point of allowing someone so wildly popular to win the election if they had an easy way to stop it?

The point here is simple -

This campaign has been going on for two years.  In all that time, NO ONE - not the other Democratic candidates, not the Republicans, not the FEC, etc. - NO ONE has been able to disprove that Obama is a citizen.

You know why?   Because Obama IS a citizen.

I believe that there is a strategy.  The question is how stupid are Americans?  At the end of the campaign can we, the republicans or democrats, say that we have forced the hand of Obama.  Exposing to the literate and ignorant to what is at stake.  The American education system has fallen, and we can doupify them.  Everybody knows that virtually every country is bi-lingual.  The question is why are Americans trained to not be able to talk to everybody else?  The answer is, behind door number one.  Americans are dumbed down, just like all you Obamaite bloggers continuously espouse.

Brian, we are not questioning your loyalty to America.  But you have to understand that in America, we do have rules about things like this, specifically the courts and the way the courts conduct business.

Sure, Obama’s birth certificate could be complete false.  It is entirely possible however, to sue him on that point you have to understand that the Judge has to treat all cases the same.  If Berg has no standing and Hawaii says the Birth Certificate is authentic, the judge really does not have a choice other than toss the case.  To do anything else would be unfair and un American. 

That is the point we are trying to make.

Perhaps the Supremes will refuse to hear Berg's appeal.  They seem disposed to dodge any questions regarding this election, such as the 200k phony Ohio voter registrations. 
There are, however, seven more suits that have been filed in state and Federal courts, in this matter.  Do you think that Obama is going to be able to dodge them all ?

If the Obama birth certificate was legitimate, by now Gov. Linda Lingle would have been on national television, holding a certified copy of the original, even if she is a Republican.  Senator Dan would have cut a deal with her to do so.   It hasn't happened, and doubtless never will.  

Obviously, the DNC strategy is to stall the question until after the election.  I would have loved to see their faces when Obama told them that he's not "Native-Born", and his documentation is fake.  This post Democratic convention, when this lawsuit came up, and they were stuck with him.    

If Obama / Biden  are elected, even if Obama is then disqualified, the Democrats still take control of the White House, the 3k political appointments, Supreme Court nominations, as well as nominations for the lower Federal courts.  The spector of 4 -16 years more of Republican rule in the White House is something the DNC are doubtless determined to avoid.

Hi, George    I might be mistaken, but am no liar.  I looked on the Hawaii State Gov. website, and didn't see anything about Obama's bc.  I searched the Hawaii Dept. of Health news releases for 2008 and 2007, and again saw nothing about Obama. 

I have likely more experience with Hawaii bc than probably anyone on the Vine.  His online bc doesn't look genuine to me.  My wife worked for the Hawaii Dept. of Health, and when I showed her the online bc, she said that she has never seen anything like it.    Are we liars ?  You decide. 

Folks who live on the mainland still place some faith in procedure and law.  Having lived in Hawaii for two decades, I'm come to realize that here, at least, in a one-party political system, that politics is everything, and procedure and law mean virtually nothing. 

This place is so corrupt that a person could probably get  decent looking documentation for the live birth of King Kong. Especially if he is a Democratic heavyweight.   Not that it would hold up under the scrutiny that Mr. Berg wanted to subject it to, thus the refusal of Obama to submit it to the Federal court.   

Please note that the Berg lawsuit and the one involving Ohio voter registrations were denied on the basis of "Standing", not on the merits of the case, or lack thereof.   The Attorney General would have standing to bring suit, and has a moral and  legal obligation to do so, but has not weighed in on the matter.

George, thanks to the Wong Kim Ark decision by the Supreme Court, if Obama were born in the US, even to alien parents (which he wasn't, as his mother was American), he'd be considered a US citizen with full rights (ie, natural born).  However, even if Obama weren't born in the US, thanks to jus sanguinis (which the US uses along with jus solis), so long as one of his parents were American, he would be one too.  And as we know, his mother is American, ergo he is American.  So no matter how you slice it, whether he was born in the US or not (and there's overwhelming evidence that he was), unless you contend that his mother was not American would there be any point to this thread.  You'd have to get him on both counts.  One won't cut it.  So, we have shown you, in multiple ways, how Obama was born in the United States.  if you don't want to believe it, fine.  Then answer this:

Do you contend that Obama's mother was not American?

Even if I concede the location of his birth (and I don't), you would still have to answer the above question in the negative for this entire line of reasoning to have any merit at all.  Otherwise it's half dozen of one, 6 of the other, and we've all got other things we could be talking about.  Like, you know, policy.  Or war.  Or something.

His mother was indeed American.  However, the issue seems to be muddied by foreign birth, foreign adoption, and most likely, failure to file to reclaim American citizenship at age 18.   I'm just guessing since the matter has yet to be judicated under oath, under penalty of perjury.  All the statements, except under oath / perjury carry little weight.  Hence the need for legal proceedings.  Which Barry wants to avoid at all costs.   It could be cleared up in one day.   If he's telling the truth.

Excuse me but what?  If his mother is American, he can claim American citizenship.  There's no evidence of foreign birth, but if there was it wouldn't matter (see: mother), if you concede that his mother is American than where does adoption figure into it, and you don't need to reclaim (ie American Citizenship) what you never lost.  He has a birth certificate.  Hawaii doesn't deny its authenticity.  Really that's all that Obama needs, right there.  And yet, conveniently, there's also supporting evidence in the form of a birth announcement in the local paper.  Obama has to prove nothing - but you know what, once an actual court asks for an actual document, above board, I'm sure he'd provide it.  But that hasn't happened.  And there's a reason for it.

Hi, Golden.  I, too, have gone through security clearances several times.  What you are ignoring are the politics of the situation.  It is vastly different, the vetting of powerless nobodies such as you, your husband, and I, and someone who is obviously a coming force in national politics.

The claim is not that Obama isn't an American citizen, although there seems to be some doubt about that.  That could be easily and quietly fixed by "personal legislation" in Congress.   The far thornier question is of "Native-Birth".  The refusal of Obama to provide documentation in the Pa. Federal court case would give pause to an observer not readily disposed to believe the charges. 

There is nothing to give George!  There is no case, the judge dismissed the case so there is no trial, no rebuttal, no arguing of the facts.  Berg has no Standing!  It was ruled to be Frivolous and not worthy of the time to hear.  Obama does not have to do anything because the Judge did not proceed to a point where Obama would have provided anything because the case was tossed.

Obama's security clearance is so hindered that it weighs down all the other contenders.  All the stuff said about McCain can directly be put on Obama. 

Brain, President Bush signed off on Obama's Security Clearance log ago.  Obama would not be able to travel to forward military bases in Afganistan without the highest level of clearances.  More so, Obamas get daily CIA briefings just like President Bush does, as does McCain.

This may shock you but the Sgt. Major of the Marine Corps, Estrada is now part of Obama's personal staff and has been since Obama toured in the Middle East.

1. There was a corresponding birth announcement in the local Hawaii paper at the time. In 1961, such announcements were automatically generated by the hospital giving the birth info to the newspapers. So the local paper or the hospital would have to be "in the tank" for Obama nearly 50 years ago.

I agree that American Citizens deserve to know the truth and n this case I am sure that the truth has already been told over and over again and that some people are refusing to accept it. What I have enormous issue with is the ruling that Berg has "no standing" to bring the case to begin with...

If I read correctly, the court has said that no voter has any standing to be heard on the issue and thus no right to even raise the question...??? That seems wrong to me. I would say that every voter has a right and a standing in a case regarding national leadership.

Crash, if you check on Snopes.com under McCain and natural born, you will find the piece they did on when he was sued in court over not being a natural born citizen. I think one Constitutional lawyer said that until the President is actually elected, no one has been harmed. No harm, no basis for a law suit. Now, does it make it wrong to have to wait until after a "harm" has been done? Yes, but that is how the law runs. I don't know of to many situations where you can file a lawsuit due to being harmed before you have been harmed. Can you?

A little Trivia....Hillary was the lead congress member that change the law regarding McCain being included as a natural born American because the law was enacted in 1937 and McCain was born in 1936 to which made him exempt from being president...and the irony....Obama supported the measure.

Actually, Berg can appeal directly to the Supreme Court before the appellate court has considered it if he can show that it's of "imperative public importance (see Rule 11 of the Supreme Court Rules) I do think he'd be able to show that, if he could convince the Court to grant cert.

And yeah, he'll be asking the Supreme Court to rule on whether or not Surrick dismissed the case improperly, which will mean they'll have to consider Berg's evidence and see whether or not he has stated a claim on which relief can be granted. In other words, they'll have to see whether or not Berg's complaint is valid (because the burden of proof is on him).

At least, that's my understanding of it.

This is mostly right.  Usually, they wouldn't examine the evidence -- namely, because Berg hasn't produced any.  The case was thrown out before a trial on standing grounds.  So Berg would have to convince SCOTUS that he has standing to make the claim.  If they agree with him, they should send it back to the district court for the actual presentation of evidence. 

What blows my mind is that, according to the District Court's opinion, Berg actually cited Inside Edition as proof that Obama was allegedly born in Kenya. 

In any event, the District Court's decision is thorough and well-reasoned.  It's highly unlikely SCOTUS will grant cert.

The evidence comes into play because it affects the standing question. In order to answer the question of whether or not he has standing to bring suit, Berg must show a personal injury to himself, and must show that the situation named in his complaint is the cause of that injury, and must show that relief can be granted by bringing suit. The Court in Allen v. Wright found that citizens do not have the standing to sue the government on behalf of nebulous third parties or hypothetical situations; they must show that they, themselves, were injured in a specific way.

So in order to sufficiently plead that his case was dismissed erroneously, Berg will have to show the Supreme Court somehow that yes, Obama is secretly not a United States citizen; that Berg was personally injured; that the fact that Obama is secretly not a United States citizen is the cause of Berg's actual injury; and that bringing this suit will redress that injury. If he can do all that, he can show that he has standing to bring the suit in the first place and it should not have been dismissed.

And that's assuming SCOTUS grants cert in the first place, and I can't imagine they're going to be able to stop laughing long enough to do that in the next week.

Which is why I find this case so amusing -- if a law student groks standing and the basics of civil procedure that much better than the former attorney general of Pennsylvania, it either says something really awesome about me or it says something really pathetic about the former attorney general of Pennsylvania. Personally, Obama's background in the law -- more specifically, his background teaching Constitutional Law -- is one of the biggest things that has me firmly in his camp. After eight years of an administration using the Constitution as toilet paper, I'd really like a President that has a passing acquaintance with what the damn thing means, especially when vacancies are probably coming up on the Supreme Court and will definitely becoming up on federal district and appeals courts (which are often even more important, and why don't people realize that?).

He may have studied Constitutional Law, but that doesn't mean he will uphold it.  Based on the common thread throughout his career, it is evident that he sees the Constitution through a radically liberal view that it must be re-interpreted, and while I agree that Bush has shredded the Constitution during his term, Obama will finish the job and we will not recognize it when he is done.  His supreme court appointees will surely finish it off.

Which is probably the BEST argument for a Democratic super majority.  The Republicans have given us a sample of their tactics over the last 2 years.  Block EVERYTHING, then accuse the Dems of being 'do nothing'.

I lived through the Vietnam war. McCain and other pow's were granted relief from prosecution if they broke under torture because the North Vietnamese did not follow the Geneva convention. This was a long war and very tiring for Americans. There was a draft and the government promoting it with lies on how well it was going. Many people avoided the draft by going to Canada. Draft cards were burnt at rallies. College students were murdered by national guard troops on Campus. A President gave up in the waining days of the conflict and kinda resigned. People seeking full disclosure from the government were pseudo heroes to some. After it was over we turned our backs on the troops coming home and had to fight the idea that we left some of our boys over there in prison camps.
That was long ago and best forgotten. McCain should be viewed in present. He should not gain points for Vietnam nor should he lose any. He should be viewed on what he says a does today which is about as close to nothing as you can get.

There actually was a lawsuit filed when McCain was a primary candidate.  It was one of the major cases cited by the cout in this Berg case as support for the dismissal.

There's no requirement for a senator to be a natural born American. In 1869, Carl Schurz was elected a Senator from Missouri. Schurz, who had been a Union general during the Civil War, was born in a small town, Erftstadt, near Cologne, Germany. He emigrated to the U.S. in 1852. Later Schurz was Rutherford B. Hayes' Secretary of the Interior. BTW, Schurz is best known for saying "My country, right or wrong; if right, to be kept right; and if wrong, to be set right."

Obama doesn't have to prove anything. The burden of proof is on Berg. Accordingly, the judge ruled the suit has no merit because of the "evidence" that Berg provided doesn't meet the burden of proof that was upon him.

In general, this is true.  However, it is not always the case.  If the defendant makes a statement of fact, they have the burden of proof to that fact.  Berg hasn't officially admitted any evidence yet because there hasn't been a trial, just a flurry of pleadings.  If he is making the claim, you can bet that he has some kind of evidence to present.  Obama is avoiding any response to avoid the tough questions and to avoid having to prove anything.  Why can't he just do like John McCain did and present the requested documents and end it all?  The question is still on the minds of millions of Americans.  Obama certainly has the legal right to handle this in this manner, however, he is running for President of the United States, this should be handled in a more politically expedient manner.

The only reason this case was dismissed is because the judge decided it was outside the subject matter jurisdiction of his court.  The door has been left open for an appeal.  Of course the Supreme Court could decide it is too much of a political hot potatoe to touch, and could cause a national crisis if it were true and would just as soon keep the peace.

The article goes on to note the same arguments that have been made here - that the birth certificate posted on Obama's website is legitimate, and that a birth announcement was found in a local paper's archives that listed his birth as August 4, 1961.

Furthermore, I can tell you that my original birth certificate (from a different state) also contained information like time of birth, the hospital and doctor that delivered me, number of live and non-living births my mother had prior to me, etc.    It even listed my parents' birthplaces and occupations. 

When I lost that original and ordered a new certificate, none of that information was provided.   It just lists the date,  parents names, and city/state.   So it's very likely that Obama cannot produce the original certificate because, like me and millions of other Americans, he lost it (or his mother or grandmother did).  Furthermore, it's possible that the hospital he was born in doesn't exist any more (it has been 46 years!), or that original records were lost, etc.  

As long as the birth was properly recorded with the state, that is all that anyone should require.    After all, it's not as if his parents knew 47 years ago that he would someday actually be able to run for President and set this all up to be sure he'd be eligible.  (And anyone wanting to make that kind of claim is an idiot.)

He's already provided his birth certificate and Hawaii has verified it. That's enough, no more needs to be done.

A couple of people have mentioned that Obama has a Passport.  It is also highly possible that he turned in his original certificate in order to get the passport, and that it was never returned.   He would be one of milions over the years that this has happened to. 

The point is, as long as the certificate he has is a state-certified copy - which it is,  and which Hawaii has attested to - then if it's good enough for obtaining a passport; driver's license; FEC, FBI and Secret Service security clearances; etc - then it damn well ought to be good enough for any of us.

Those of you who refuse to believe the evidence and the facts that have been laid out for you, and refuse to trust that all the agencies listed above actually know how to check someone's records and verify the accuracy of the documents presented, are not being smart or skeptical - you're being downright ignorant and foolish.   You're basically saying that even if you had been standing right there in the delivery room when he was born, you still wouldn't believe he was a citizen, because you want an excuse to get him out of the race for President.

Those quotes are not reasons based in law, they are commentary by the judge.  Your reference is to a news report.  Try looking at the actual document.  The stated reason on the judges order is simply that he lacks subject matter jurisdiction.

Berg's complaint asked for Obama to produce his birth certificate for the court.  Instead he posted it on his website.  I'm simply talking about the lawsuit, not the court of public opinion.  Producing it for the court would have been the way to get the case immediately dismissed and ruled that he is a citizen so that all questions would be quelched.  Posting it on his website simply fueled the fire.

The reason that the court granted dismissal based on jurisdiction is a result of Plaintiff lacking standing to bring such a case. 'Desire does not create standing.' 

If, through the political process, Congress determines that citizens, voters, or party members should police the Constitution’s eligibility requirements for the Presidency, then it is free to pass laws conferring standing on individuals like Plaintiff. Until that time, voters do not have standing to bring the sort of challenge that Plaintiff attempts to bring in the Amended Complaint.

What this is basically saying is that a private citizen has no standing to police the Constitutional requirements for President.  It is for this reason that the case will most likely not be heard by the Supreme Court.

Timeout, the Governor of Hawaii filed a memo with the Federal Court attesting that the Birth Certificate was authentic.  You can read the memo from the Hawaii Dept of Health on the state website.  More so, Fox News already did a whole piece about it.

Mary, the Federal courts do not have time to sit around listening to a diatribe of innuendoes about what a third party heard in a coffee shop or read on the internet. 

If you sue someone, in this case Obama, you have to show the court that you have standing and that damages occurred for the case to proceed.  The Birth Certificate is a product of the State of Hawaii therefore Hawaii is the benefactor of the certificate.  If Hawaii says that the certificate is authentic, then it is regardless of what anyone else may believe or say.  If Hawaii thinks it has somehow incurred damages by Obama, then it is up to the Hawaii Attorney General to sue Obama, not Berg or anyone else. 

Berg’s lawsuit is, as the court has found, frivolous and without standing or facts.  There is nothing to appeal or procedural questions to be answered by the Supreme Court.  Remember, the Supreme court does not determine facts in cases, it only hear procedural questions about how the facts were derived in a trial.    

Much of what the GOP spins on the internet regarding this topic is frivolous and without factual basis. 

If you want to gripe about something, how about Berg wasting Tax Payer time and money bringing yet another frivolous lawsuit. 

If you want to complain about Obama, though I voted for him, I do have some criticisms regarding his economic proposals in believing they will ever pass muster in congress, even a democrat controlled congress.  In McCain’s defense, he did openly admittedly adopt Hillary’s economic plan which has a much better chance of passing in congress.  Of course, I wonder why McCain had to use Hillary’s plan and not come up with his own plan which is why I voted for Obama because Obama was smart enough to write a plan even though he will probably end up using Hillary’s plan anyway not because he likes it, but for the simple reason it just more reasonable.

Actually that does not matter in that case. McCain was still not a "natural born citizen" thye law regarding that was enacted in 1937, McCain was born in 1936.

It was actually Hillary Clinton that brought this to the front and initiated a movement that allowed McCain to be included o that law. Obama actually voted FOR the amendment.

If you read the 1937 law it was retroactive to those born on or after 1904.

...Any person born in the Republic of Panama on or after February 26, 1904, and whether before or after the effective date of this Act, whose father or mother or both at the time of birth of such person was or is a citizen ofthe Unied States employed by the Government of the United States or by the Panama Railroad Company, or its successor in title, is declared to be a citizen of the United States.

So, even if he were born in Colon, and not on the base, he is still a "natural born" citizen according to the retroactive provisions of the 1937 law which encompasses anyone born in Panama to two parents who were citizens.

There is a difference between a citizen and a natural born citizen. Arnold is a citizen, yet he cannot legally be president.
